Welcome to Huntocity. These terms and conditions ("Terms") govern your access to and use of the treasure hunt application ("Application"), including any content, functionality, and services offered through the Application. By using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Application.

Eligibility

The Application is intended for use by individuals who are at least 18 years old. If you are under 18, you may only use the Application with the involvement of a parent or guardian.

User Accounts

To use certain features of the Application, you may need to create an account. You agree to provide accurate and complete information when creating your account, and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account login credentials, and you agree not to share your login credentials with anyone else. You are responsible for all activities that occur under your account.

Treasure Hunts

The Application provides access to various treasure hunts, which may be created by us or by third parties. We do not guarantee the accuracy, completeness, or safety of any treasure hunt, and you agree to assume all risks associated with participating in a treasure hunt. You agree to comply with any rules or instructions provided in connection with a treasure hunt, and to follow all applicable laws and regulations.

User Content

You may be able to submit content to the Application, such as photos, comments, or other materials. By submitting content, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, reproduce, distribute, display, and perform the content in connection with the Application. You represent and warrant that you own or have the necessary rights and permissions to submit the content, and that the content does not violate any applicable laws or regulations or infringe any third-party rights.

Prohibited Conduct

You agree not to engage in any of the following activities in connection with the Application:

Intellectual Property

The Application and all content and materials contained in the Application, including but not limited to text, graphics, logos, images, and software, are owned or licensed by us and are protected by applicable intellectual property laws. You may not use or reproduce any of the content or materials in the Application without our prior written consent.

Disclaimers and Limitations of Liability

THE APPLICATION AND ALL CONTENT AND MATERIALS CONTAINED IN THE APPLICATION ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APPLICATION, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, OR LOSS OF DATA.

Indemnification

You agree to indemnify and hold us and our officers, directors, employees, and agents harmless from any claims, actions, suits, demands, damages, liabilities,costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Application or your violation of these Terms.

Termination

We may terminate or suspend your access to the Application at any time and without notice, for any reason or no reason, including if we believe you have violated these Terms or any applicable law or regulation.

Governing Law and Dispute Resolution

These Terms and your use of the Application will be governed by and construed in accordance with the laws of the jurisdiction in which you reside, without giving effect to any choice of law principles. Any dispute arising out of or in connection with these Terms or your use of the Application will be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association, and you waive any right to bring any claim against us in any other forum.

Modifications to These Terms

We may modify these Terms at any time and without notice, and any modifications will be effective immediately upon posting. Your continued use of the Application after any modification to these Terms will constitute your acceptance of the modified Terms.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding your use of the Application. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms or any of our rights or obligations under these Terms without your consent.
